1. Acceptance of Terms

These Terms of Service ("Terms") form a binding agreement between you and AZIZ SHUAIB AUSI, an individual sole proprietor trading as Aziz Shuaib Ausi (the "Site Owner", "we" or "us"). By accessing the website atazizshuaib.com, registering for an account or using any related service, you confirm that you have read, understood and accepted these Terms. If you do not agree, please do not use the services.

The website provides information about the Site Owner's professional work in educational leadership, governance and organizational performance, together with a member platform offering access to research, resources, insights and related programmes. Some features require account registration and approval.

3. Eligibility & Accounts

• You must be at least 18 years old to create an account.
• You must provide accurate, complete and current information during registration.
• You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
• Accounts are personal. You may not share, transfer or sell access to your account.
• Registrations may be subject to administrator review and approval, and may be declined at the Site Owner's discretion.

Resources, research materials and frameworks made available through the member platform are provided for informational and professional development purposes. They are shared in good faith and do not constitute legal, financial or regulatory advice. You remain responsible for evaluating their suitability before applying them in your institutional context.

7. Fees & Payments

The only products sold through this website are digital: online membership access to the member platform, and downloadable publications such as frameworks, reports, toolkits and guides. Advisory, facilitation and consulting engagements are not sold, priced or paid for through this website; they are contracted separately by written agreement and invoiced directly to the institution.

For the digital products above, the applicable fees, currency, billing cycle and renewal terms are presented to you before you complete your purchase. Subscriptions renew for the stated period until cancelled, and you may cancel at any time from your member area.

Card, wallet and mobile-money payments are collected through our payment gateway on our behalf. Local payments in Tanzanian shillings by bank transfer or mobile money are handled directly by AZIZ SHUAIB AUSI, and access is granted once payment has been verified.

8. Seller of Record and Payment Processing

AZIZ SHUAIB AUSI is the seller and merchant of record for every order placed on this website. Your contract of sale is with us directly. We issue your invoice, provide all customer service and handle every refund.

Payments are executed on our behalf by a licensed payment gateway, which collects and secures your payment details so that no card or wallet credentials are stored on this website. The gateway acts as our payment service provider only; it is not the seller, and it does not determine the price, the product or your rights under these Terms.

Applicable taxes are shown before you complete your purchase and are accounted for by us. Your use of the services remains governed by these Terms. Please also see our Refund Policy.

9. Suspension & Termination

We may suspend or terminate your access at any time, with or without notice, if you breach these Terms, misuse the services, or if continued provision would expose us or other users to risk. You may close your account at any time by contacting us. Provisions intended to survive termination (such as intellectual property, disclaimers and limitation of liability) will continue to apply.

10. Disclaimers

The services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the platform will be uninterrupted, error-free or secure against every possible threat.

11. Limitation of Liability

To the fullest extent permitted by law, Aziz Shuaib Ausi will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill arising from your use of the services. Our total cumulative liability under these Terms will not exceed the amount you paid to us in the twelve months preceding the event giving rise to the claim, or USD 100 if no payment was made.

12. Third-Party Services

The platform integrates third-party services for authentication (including Google sign-in), hosting, database, email delivery and analytics. Your use of these integrations is also governed by the respective providers' terms and privacy policies.

13. Privacy

Our handling of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

14. Changes to the Services or Terms

We may modify the services or these Terms at any time. Material changes will be communicated through the website and, where appropriate, by email. Continued use of the services after such changes constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of the United Republic of Tanzania, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms will be resolved in the competent courts of Tanzania, except where mandatory consumer-protection laws require otherwise.
